1. Introduction
Welcome to Needle Gem. This Refund Policy details the terms and conditions regarding refunds for all subscription services offered by Ahardane Amine (operating as “Needle Gem”, “we,” “us,” or “our”), a sole proprietorship registered in Italy with VAT number IT01281140572. This policy is a legally binding part of our Terms of Service. By making a purchase on our platform, you acknowledge and agree to the terms outlined in this policy.
2. Subscription Services
This section applies to all our recurring monthly and annual subscription plans, including the Founder’s Beta plan.
a) 30-Day Free Trial (Founder’s Beta Program)
Our Founder’s Beta program includes a 30-day free trial. If you cancel your subscription through your account dashboard at any time before the trial period ends, you will not be charged.
b) General Subscription & Cancellation Policy
You may cancel your subscription at any time via your account dashboard. Your cancellation will take effect at the end of your current paid billing period. You will continue to have access to the service until the end of that period.
c) No Refunds for Subscription Fees
All payments for subscription services are non-refundable. We do not offer refunds or credits for partial subscription periods, unused time, or any other reason once a payment has been processed. This policy applies to all subscription tiers and billing cycles (monthly or annual).
3. Exceptions and Legal Guarantees
While our policy is that all sales are final, we will consider issuing a refund under the following limited circumstances:
Confirmed Billing Errors
If you believe you have been charged incorrectly due to a technical error in our billing system, please contact us immediately. If we confirm a billing error, we will issue a full or partial refund for the amount charged in error.
Legally Mandated Refunds
This policy does not override any mandatory consumer protection rights or “cooling-off” periods you may be entitled to under the laws of your jurisdiction. However, please note the important waiver described in Section 4 below regarding digital content and immediate performance.
Any decision to grant a refund outside of these specific exceptions is at our sole discretion.
4. Digital Content and Immediate Performance (Waiver of Withdrawal Right)
Important Notice for Consumers: Needle Gem provides digital content (software-as-a-service) that begins immediately upon subscription activation.
Waiver Under Italian and EU Law:
In accordance with Article 59, letter o) of Italian Legislative Decree 206/2005 (Codice del Consumo - Consumer Code) and Article 16(m) of EU Directive 2011/83/EU, the 14-day right of withdrawal does NOT apply to the supply of digital content which is not supplied on a tangible medium if the performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal.
By subscribing to Needle Gem, you expressly acknowledge and agree that:
- The Service constitutes digital content that is delivered electronically (not on a physical medium)
- Performance of the Service (access to your dashboard, AI curation, overlay generation) begins immediately upon successful subscription
- You expressly request immediate access to the Service upon subscription
- By requesting immediate performance, you waive your 14-day right of withdrawal under Italian and EU consumer protection law
Confirmation: During the subscription checkout process, you will be required to confirm this waiver before your subscription is activated. This ensures you are fully informed of your rights and the consequences of requesting immediate performance.
Trial Period: Our 30-day free trial allows you to evaluate the Service before any payment is processed. If you cancel during the trial period, you will not be charged.
5. How to Request a Review
To request a refund based on a billing error or a legal guarantee, please contact our support team with your account email, the transaction date and amount, and a detailed explanation of the issue.

We reserve the right to modify this Refund Policy at any time. We will notify you of significant changes by updating the “Last Updated” date on this page and, where appropriate, by email or through a notice on our dashboard.
